  • As conveyancers, we focus solely on property purchases, sales and other property related transactions. Given this is a big step for most people with a lot of their hard earned money being used, our focus is purely on completing the matter to a high standard and our knowledge and skills in this area of law are valuable in achieving that. At Insight Conveyancing, we are fully licensed by NSW Fair Trading and are trained to handle your property transaction.

  • This is an exciting step for you and we would love to assist you! Giving us a call so we can provide you with some of the early steps will help, but we also encourage you to speak to your broker or lender to see what your borrowing capacity is and to obtain pre-approval for your loan. As this can often take a few weeks, it is good to get this step sorted before you go looking for your perfect property and have your heart set on it but are not quite ready to take the necessary steps to secure it.

  • Exchange of Contracts can happen two ways:
    1. with a cooling off period which is 5 business days but can be extended to 10 business days if agreed by the Vendor.

    2. With a Section 66W Certificate which waives your right to any cooling off period and locks you into the purchase from the moment the Contracts are exchanged.

    You should be careful to agree to signing a Contract for exchange under a Section 66W Certificate as a cooling off period is often needed to obtain formal loan approval, undertaken any pre-purchase property enquiries, have our office explain the Contract and the terms thereof to you etc. A cooling off period gives you the time to do all these things without the Vendor being able to sell the property to anyone else. Not being rushed into an unconditional Contract gives you the confidence that the decisions you are making are the best for you.

    You need to understand that when exchanging a Contract under a cooling off period, you will need to pay a deposit of 0.25% of the purchase price for Contracts to be exchanged and the property taken off the market for that 5 business day period. If you decide to rescind during the cooling off period, you will lose that holding deposit and it will be given to the Vendor. If you proceed with the purchase, this holding deposit is incorporated into the 10% deposit payable by the end of the cooling off period.

  • During the settlement period, we will work with you and your bank to prepare for settlement. You will be required to sign Mortgage documents to enable your bank to prepare for settlement. We will also order the necessary searches to enable settlement to take place. We will ask you to sign various documents we require to settle and will also guide you to whatever else we may need from you particular to your matter. We are available to chat with any questions you may have during this time so feel free to pick up the phone or send us an email with any questions you may have. Attending to your bank/s and/or our requests quickly will ensure there are no delays at settlement which could cost you financially.

  • Settlement, or Completion as it is also known, is the process where the funds are handed over to the Vendor and the Purchaser takes legal ownership of the property. We will send you a Pre-Settlement letter prior to settlement to set out the financial aspects so you are comfortable as to what is happening with your money. If you are buying property, you will need to complete a Final Inspection of the property to ensure it is in the same state as it was when you purchased it (less the Vendor’s possessions).

    You don’t need to be anywhere in particular for settlement. It all happens electronically and funds are disbursed to your nominated bank accounts.
